OVERVIEW Welcome to Metrographie by Studio MLR (“Metrographie,” “we,” “us”). We operate this website to provide you with a curated shopping experience (the “Services”), powered by Shopify. By visiting or purchasing from us, you agree to be bound by the following Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, you may not use our Services.

SECTION 1 - ACCESS AND ACCOUNT By using this site, you represent you are at least the age of majority in your jurisdiction. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide current, complete, and accurate purchase and account information. You may not sell or transfer your account to another party.

SECTION 2 - OUR PRODUCTS We strive to display our products as accurately as possible. However, we cannot guarantee that your computer monitor's display of any color or detail will be accurate. We do not warrant that the quality of any products or services will meet your expectations. We reserve the right to limit sales to any person or jurisdiction, discontinue products, or change prices and descriptions at any time without notice.

SECTION 3 - ORDERS All orders are offers to purchase subject to our acceptance. We reserve the right to refuse or cancel any order for any reason. You agree that your purchases are for personal use and not for commercial resale. Returns are governed by our Refund Policy. Please note that specific restrictions regarding order cancellation apply to physical prints, as detailed in Section 6.

SECTION 4 - PRICES AND BILLING Prices are subject to change without notice. You are responsible for all taxes and shipping charges associated with your order. We reserve the right to modify or discontinue the Service without notice at any time. You agree to provide current, complete, and accurate purchase and account information for all purchases.

SECTION 5 - SHIPPING AND DELIVERY Delivery times are estimates and are not guaranteed. We are not liable for delays caused by carriers, customs, or events outside our control. Risk of loss and title for products pass to you upon our delivery to the carrier.

SECTION 6 - THIRD-PARTY FULFILLMENT AND PRINT-ON-DEMAND Production Partner: Physical print products are produced and fulfilled by Gelato, our third-party print-on-demand partner. When you order a physical print, you authorize us to share your order details (name, address, email) with Gelato solely for production and delivery.Division of Responsibilities: Metrographie is responsible for the artwork quality, product descriptions, and customer service. Gelato is responsible for physical printing, materials, packaging, and shipping. Made-to-Order Policy: Physical prints are custom-made upon order placement. Once your order enters production with Gelato, it cannot be cancelled or modified. Please review your order carefully before purchasing. Quality & Variations: While we provide professional-grade files, the physical printing process may result in normal variations. These include slight differences in color saturation, paper texture, or finish between your digital display and the final physical print. These variations are inherent to the print process and do not constitute defects for returns or refunds. Timelines & Liability: Production and shipping timelines are estimates provided by Gelato and subject to change. While we will coordinate with Gelato to resolve issues, Metrographie is not liable for production defects caused by Gelato’s manufacturing, carrier delays, or customs fees.

SECTION 7 - INTELLECTUAL PROPERTY All content included in the Services, such as text, graphics, logos, images, and software, is the property of Metrographie by Studio MLR or its content suppliers and is protected by copyright and trademark laws. You are granted a limited license to access and make personal use of this site. You may not download, modify, reproduce, or use our content for any commercial purpose without express written consent. No content from the Services (including product images, descriptions, or artwork) may be used for the development, training, or fine-tuning of any artificial intelligence or machine learning systems.

SECTION 8 - OPTIONAL TOOLS We may provide access to third-party tools over which we have no control or input. You acknowledge that we provide access to such tools “as is” without any warranties or endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

SECTION 9 - THIRD-PARTY LINKS Certain content, products, and services available via our Service may include materials from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites.

SECTION 10 - RELATIONSHIP WITH SHOPIFY Metrographie by Studio MLR is powered by Shopify. However, any sales and purchases you make are made directly with Metrographie. You acknowledge and agree that Shopify is not responsible for any aspect of sales between you and us, including any injury, damage, or loss resulting from purchased products. You release Shopify and its affiliates from all claims arising from your transactions with us.

SECTION 11 - PRIVACY POLICY Your submission of personal information through the store is governed by our Privacy Policy. By using the Services, you acknowledge that you have read our Privacy Policy and understand that your data may be transferred to and processed by Shopify, Gelato (for fulfillment), and other third parties to provide the Services.

SECTION 12 - FEEDBACK If you send us creative ideas, suggestions, proposals, plans, or other materials (collectively, “Feedback”), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any Feedback that you forward to us. We are under no obligation to maintain any Feedback in confidence, pay compensation, or respond to any Feedback.

SECTION 13 - ERRORS, INACCURACIES AND OMISSIONS Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors and to change or update information or cancel orders if any information is inaccurate at any time without prior notice.

These Terms are effective unless and until terminated by either you or us. We may terminate this agreement at any time without notice if in our sole judgment you fail to comply with any term.

SECTION 16 - DISCLAIMER OF WARRANTIES WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT YOUR USE OF OUR SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. THE SERVICES AND ALL PRODUCTS DELIVERED TO YOU ARE (EXCEPT AS EXPRESSLY STATED BY US) PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

SECTION 17 - LIMITATION OF LIABILITY IN NO CASE SHALL METROGRAPHIE BY STUDIO MLR, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICE OR ANY PRODUCTS PROCURED USING THE SERVICE.

SECTION 18 - INDEMNIFICATION You agree to indemnify, defend and hold harmless Metrographie by Studio MLR and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms or the documents they incorporate by reference.

SECTION 19 - SEVERABILITY In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms.

SECTION 20 - WAIVER; ENTIRE AGREEMENT The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms and any policies or operating rules posted by us constitute the entire agreement and understanding between you and us and govern your use of the Service.

SECTION 21 - ASSIGNMENT You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms at any time without notice to you.

SECTION 22 - GOVERNING LAW These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Metrographie by Studio MLR is headquartered, without regard to principles of conflicts of law.

SECTION 23 - HEADINGS The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 24 - CHANGES TO TERMS OF SERVICE You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms by posting updates to our website. Your continued use of or access to our website following the posting of any changes constitutes acceptance of those changes.

ARTICLE 6 - EXÉCUTION PAR DES TIERS ET IMPRESSION SUR DEMANDE Partenaire de production : Les produits d'impression physique sont produits et exécutés par Gelato, notre partenaire tiers d'impression sur demande. Lorsque vous commandez une impression physique, vous nous autorisez à partager les détails de votre commande (nom, adresse, courriel) avec Gelato uniquement à des fins de production et de livraison. Répartition des responsabilités :Metrographie est responsable de la qualité de l'œuvre, des descriptions de produits et du service à la clientèle. Gelato est responsable de l'impression physique, des matériaux, de l'emballage et de l'expédition. Politique de fabrication sur commande : Les impressions physiques sont fabriquées sur mesure lors du placement de la commande. Une fois que votre commande entre en production chez Gelato, elle ne peut être ni annulée ni modifiée. Veuillez vérifier attentivement votre commande avant d'acheter. Qualité et variations : Bien que nous fournissions des fichiers de qualité professionnelle, le processus d'impression physique peut entraîner des variations normales. Celles-ci incluent de légères différences de saturation des couleurs, de texture du papier ou de finition entre votre affichage numérique et l'impression physique finale. Ces variations sont inhérentes au processus d'impression et ne constituent pas des défauts justifiant un retour ou un remboursement. Délais et responsabilité : Les délais de production et d'expédition sont des estimations fournies par Gelato et sont sujets à changement. Bien que nous nous coordonnions avec Gelato pour résoudre les problèmes, Metrographie n'est pas responsable des défauts de production causés par la fabrication de Gelato, des retards des transporteurs ou des frais de douane.

ARTICLE 17 - LIMITATION DE RESPONSABILITÉ EN AUCUN CAS METROGRAPHIE PAR STUDIO MLR, NOS DIRECTEURS, OFFICIERS, EMPLOYÉS, AFFILIÉS, AGENTS, CONTRACTANTS OU LICENCIÉS NE SERONT RESPONSABLES DE TOUTE BLESSURE, PERTE, RÉCLAMATION, OU DE TOUT DOMMAGE DIRECT, INDIRECT, ACCESSOIRE, PUNITIF, SPÉCIAL OU CONSÉCUTIF DE QUELQUE NATURE QUE CE SOIT, Y COMPRIS, SANS LIMITATION, LA PERTE DE PROFITS, LA PERTE DE REVENUS, LA PERTE D'ÉCONOMIES, LA PERTE DE DONNÉES, LES COÛTS DE REMPLACEMENT, OU TOUT DOMMAGE SIMILAIRE, QU'IL SOIT BASÉ SUR UN CONTRAT, UN DÉLIT (Y COMPRIS LA NÉGLIGENCE), UNE RESPONSABILITÉ STRICTE OU AUTRE, DÉCOULANT DE VOTRE UTILISATION DU SERVICE OU DE TOUT PRODUIT OBTENU À L'AIDE DU SERVICE.

ARTICLE 18 - INDEMNISATION Vous acceptez d'indemniser, de défendre et de dégager de toute responsabilité Metrographie par Studio MLR et nos sociétés mères, filiales, affiliés, partenaires, officiers, directeurs, agents, contractants, concédants de licence, prestataires de services, sous-traitants, stagiaires et employés, de toute réclamation ou demande, y compris les honoraires raisonnables d'avocat, faite par un tiers en raison de ou découlant de votre violation de ces Conditions ou des documents qu'elles incorporent par référence.

ARTICLE 19 - DISSOCIABILITÉ Dans le cas où une disposition de ces Conditions serait jugée illégale, nulle ou inapplicable, cette disposition sera néanmoins exécutoire dans toute la mesure permise par la loi applicable, et la partie inapplicable sera réputée être dissociée de ces Conditions.

ARTICLE 20 - NON-RENONCIATION ; INTÉGRALITÉ DE L'ACCORD Le fait pour nous de ne pas exercer ou appliquer un droit ou une disposition de ces Conditions ne constitue pas une renonciation à ce droit ou à cette disposition. Ces Conditions et toutes les politiques ou règles d'exploitation publiées par nous constituent l'intégralité de l'accord et de la compréhension entre vous et nous et régissent votre utilisation du Service.

ARTICLE 21 - CESSION Vous ne pouvez pas céder vos droits ou obligations en vertu de ces Conditions sans notre consentement écrit préalable. Nous pouvons céder nos droits et obligations en vertu de ces Conditions à tout moment sans vous en aviser.

ARTICLE 22 - LOI APPLICABLE Ces Conditions seront régies et interprétées conformément aux lois de la juridiction où Metrographie par Studio MLR a son siège social, sans égard aux principes de conflits de lois.

ARTICLE 23 - TITRES Les titres utilisés dans cet accord sont inclus uniquement pour la commodité et ne limiteront ni n'affecteront autrement ces Conditions.

ARTICLE 24 - MODIFICATIONS DES CONDITIONS D'UTILISATION Vous pouvez consulter la version la plus récente des Conditions d'utilisation à tout moment sur cette page. Nous nous réservons le droit de mettre à jour, de modifier ou de remplacer toute partie de ces Conditions en publiant des mises à jour sur notre site web. Votre utilisation continue ou votre accès à notre site web après la publication de toute modification constitue une acceptation de ces modifications.
